Edward Romero

Edward Romero represents individuals, small businesses and institutional clients in federal and state trials and appeals involving class actions, employment matters, environmental contamination, officer and director liability, trade secrets and intellectual property disputes and other complex litigation. Ed also prosecutes and defends cases involving the Consumers Legal Remedies Act, California Civil Code section 1750 et seq. (the “CLRA”); the Unfair Competition Law, California Business and Professions Code sections 17200 et seq. (the “UCL”); the Petroleum Marketing Practices Act, 15 U.S.C. section 2801 et seq. (the “PMPA”) and the Computer Fraud and Abuse Act, 18 U.S.C. section 1030 et seq.

CLASS AND UCL ACTIONS. For over a decade, Ed has prosecuted and defended class and other representative actions involving consumer fraud; health care and securities fraud; variable life insurance products; vanishing insurance premiums; forced-placed insurance and reverse mortgage lending.

EMPLOYMENT. Ed also represents employers who have been wrongfully accused of harassment, gender or racial discrimination or violating wage and hour laws. He also represents employees who have been victimized by discrimination or who have not been paid all wages or benefits owed to them by their employer. Among the matters which Ed has prosecuted is that of a former executive of a technology company who brought suit against his former employer for breach of contract and violation of California laws, resulting in the payment of all moneys owed to the client.

ENVIRONMENTAL CONTAMINATION. Ed represents current and former landowners and other potentially responsible parties in civil litigation and administrative proceedings involving the remediation of petroleum hydrocarbons, methyl tertiary butyl ether (“MTBE”), perchloroethylene (“PCE”) and other contaminants to real property and the purported failure to comply with various provisions of the California Health and Safety Code.

OFFICER AND DIRECTOR LIABLITY. Ed also represents corporate officers and directors who are falsely accused of breaching their fiduciary duties to shareholders. Among those matters which Ed has defended is the representation of the chief executive of a nationally-known, privately held company who also served on the board of directors of a technology company and who was wrongfully accused by its shareholders of fraud and breach of fiduciary duty. Ed obtained a judgment dismissing the action, with prejudice, at the pleading stage.

TRADE SECRETS AND INTELLECTUAL PROPERTY. Ed has for over a decade represented numerous individuals and companies who have been unjustly accused of stealing the trade secrets and intellectual property of competitors. He also prosecutes federal and state actions against individuals and businesses that have misappropriated the trade secrets and intellectual property of his clients or who have violated the Computer Fraud and Abuse Act, 18 U.S.C. section 1030 et seq., which prohibits the unauthorized access of computers used in interstate or international commerce.

COMPLEX LITIGATION. Among the complex matters handled by Ed is the representation of a former chief executive of a California software company in a federal action against a national heath care company and its subsidiary for breach of contract and business torts, resulting in a multi-million dollar recovery on behalf of the client. Ed has also represented a Saudi Arabian corporation in a federal action against an international software company for breach of a joint venture agreement, resulting in the recovery of millions of dollars owed to the plaintiff.

Ed received his baccalaureate from Stanford University and his law degree from Boalt Hall School of Law at the University of California, Berkeley. His reported decisions include Heartland Communications, Inc. v. Sprint Corporation and Lasley v. New England Life Insurance Company.
